PROCLAMATION
WHEREAS, by proclamation dated March 14, 2020, issued by Tate Reeves, Governor of the state of Mississippi, a state of emergency was declared pursuant to Miss. Code Ann. Section §33-15-11, in order to address the high risk for an outbreak of the novel coronavirus, identified as COVID-19, in the state of Mississippi; and
WHEREAS, the Proclamation has invoked the emergency powers of the Governor pursuant to Miss. Code Ann. Section §33-15-11(c)(1) to temporarily suspend or modify any rule or regulation of a state agency which would in any way prevent, hinder or delay necessary action in coping with the emergency; and
WHEREAS, the Mississippi Autism Board, as an agency of the state of Mississippi charged with the regulation of the practice of applied behavioral analysis, wishes to comply with the Governor's proclamation and take those steps necessary to address access to needed medical care, including behavioral analysis, to the citizens of the state of Mississippi during this time of emergency and to assist its licensees in continuing practice while coping with the pandemic; and
WHEREAS, the Mississippi Autism Board recognizes that travel and meeting in groups may increase the risk of COVID-19 transmission; and
WHEREAS, Rule 6.2(c) of the Board's Rules and Regulations requires that no more than 50% of the total number of continuing education hours submitted for credit each year may result from online or home study courses; and
WHEREAS, the Board recognizes that enforcement of Rule 6.2(c) may result in the unnecessary travel and meeting in groups of more than ten (10) persons, increasing the possible risk of transmission of the virus to its licensees;
NOW THEREFORE, due to the present state of emergency, the Board will not enforce the requirement of Rule 6.2 (c) of its Rules and Regulations that 50% of continuing education hours be taken in person for those hours submitted for credit for the licensing year beginning on July 1, 2019 and ending on June 30th, 2020; and
FURTHER, except as specially state herein, all other regulations remain in full force and effect.
