RE: CLARIFICATION OF TIMELINE FOR PHARMACY RESPONSE TO PRELIMINARY AUDIT REPORTS

It has come to the attention of the Commissioner that certain statutory time frames found in O.C.G.A. §26-4-118 must be clarified. Specifically, the 60 day time period in which a pharmacy can respond to a preliminary audit report and have such responses considered by the auditing entity appears to conflict with the time period in which the auditing entity has 60 days to deliver its final audit report.

In order to fully provide pharmacies the gurantee of at least 60 days as required by the statute, henceforth, the final audit report shall be delivered to the pharmacy within 90 days after receipt of the preliminary audit report or final appeal, whichever is later.
